Please note, these terms and conditions are subject to change, at the discretion of Synergy Education Services LTD.

In this document Synergy Education Services is written as the abbreviation SES.

Customers/clients agree to these terms and conditions when booking an event with SES, meaning personnel, trainers, Associates of SES.

Schools refer to any type of educational establishment.

Primary customer is the one who is responsible for initiating and/or managing the booking. Customer or client is the one who is responsible for coordinating the attendees and the actual attendees/delegates and/or participants in SES online services.

Section A – Services provided onsite

1. Bookings

1.1  Customers/clients must book SES services by using the online booking form, or by email to:  admin@synergyeducationservices.co.uk or jean.watt@synergyeducationservices.co.uk

1.2 The service to be provided, dates, times and costs will be agreed at the time of booking.

1.3  All costs are subject to the relevant VAT rate.

1.4  The number of attendees must be agreed at the time of booking. Additional places may incur an additional charge.

1.5  Clients may not charge attendees more than what was agreed with SES, other than to cover their total costs.

1.6  Upon the client’s verbal or written acceptance of the contract, SES will send a confirmation email and/or give a verbal acceptance. Subsequently, a purchase order may be provided by the client but is not deemed necessary for contractual purposes.

1.7  Online training may be done to replace a planned in-school training, in the event it is not reasonable to continue with the in-school training, such as would compromise the attendees or SES trainers’ safety.

1.8  Online training may be used, as per the agreement of SES and the client. In such cases, Section 1.1.1 to 1.1.6 applies.

2.  Cancellation and refund

Whilst we understand that from time to time clients may need to cancel, the following terms apply:

2.1  Cancellation by clients of in-person meetings must be communicated via email to: admin@synergyeducationservices.co.uk  or

2.2 Cancellation of online bookings such as training courses, coaching programmes must be cancelled using the cancellation form, or/and if not available by email.

2.3  Cancellation received to SES of over 28 days before the scheduled event will incur a charge of 25%. Cancellation received to SES from 15 to 28 days before the scheduled event will incur a charge of 50% of the agreed fee. Cancellation received to SES less than 15 days before the scheduled event will incur a charge of 100% of agreed fee.

2.4 If the event is going to be cancelled due to the clients/delegates unable to meet in-person, the option of meeting online should be considered.

2.5 If the client is unable to attend, the client may be able to substitute their place to someone else in their school/Trust by prior arrangement and informing Synergy by email. The substitute client’s details (as would be required in the booking form) must be provided in the email. Full payment will be required, but no additional charge will be incurred by the client.

2.6  SES reserves the right to cancel if clients request changes to be made to the time, venue and agreed services.

2.7 Synergy reserves the right to cancel a course if number of delegates have not reached the minimum required to run the course effectively. 

2.8  If SES needs to cancel, the trainers will endeavour to reschedule at a time that is mutually convenient or offer a full refund of the fee paid. Our clients will act reasonably in accepting such alternatives. SES does not accept liability for any failure to provide the services contracted, which is due to circumstances beyond the control of the company.

3. Invoices and payments

3.1    Total price will include VAT, where applicable. A day rate constitutes 6 hours. Additional hours, pro rata, will incur an additional charge of £100 per hour.

3.2   Mileage may be charged at a rate per mile or total. This will be agreed prior to the scheduled event.

3.3    Subsistence may be charged. This will be agreed prior to the scheduled event.

3.4    In some cases a deposit must be paid, to secure a booking, before the service is provided. This will be at the discretion of SES. In such cases, if the deposit is unpaid SES will not be able to guarantee the provision of a booking.

3.5    All payment must be made in pound sterling.

3.6    Payments must be made within 14 days of the invoice date.

3.7    Where it is agreed there will be multiple visits or training days, payment may be due at the end of each visit. This will be agreed before the first scheduled event.

3.8   Payments must be made to Synergy Education Services.

3.9    Late payment may incur an additional charge.

4. Events and attendance

4.1  The number of attendees must be agreed before the day of the event. If other schools/partners are to attend, this must be agreed beforehand with the primary customer and SES.

4.2  The customer will provide the necessary resources including, but not limited to, an adequate room/setting, internet connection, overhead projector.

4.3   Customers may not film or record the event, unless permission is given, which must be agreed with SES before the event.

4.4   If permission is granted by SES to take pictures, this must not be shared, distributed in any form, with others internal or external to the customers’ organisation. However, attendees may use it for their own personal use.

 

Section BUse of website, access and online events

5. This agreement is between Synergy Education Services and you the ‘user’, registered or unregistered of the website, and include customers/clients.

5.1 All content, materials, and resources available on this website—including but not limited to text, graphics, logos, images, videos, course materials, downloadable documents, and design elements—are the property of Synergy Education services and are protected by copyright, trademark, and other intellectual property laws.

5.2 By accessing and using SES’ website to obtain information, make bookings, or pay for services, users agree to the following terms and conditions:

5.2.1 Users agree to use this website only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use of, this site by others.

5.2.2 Users must not copy, reproduce, modify, republish, upload, post, transmit, or distribute any part of the website or its materials without prior written permission from SES.

5.2.3 Users must not use any content from this website for commercial purposes, resale, or redistribution.

5.2.4 Users must not create derivative works based on any materials or content found on this website.

5.2.5 Users must not reverse-engineer, decompile, or disassemble any part of the website or its functionality.

5.2.6 SES reserve the right to modify or withdraw (any part or all of the website) and discontinue the website without notice.

5.2.7 SES reserves the right to modify or replace this section of the agreement at any time. Continued use of the website after changes are posted constitutes your acceptance of the revised terms.

5.2.8 SES grants the user a non-exclusive, non-transferable, non-sublicensable right to access and use the website for the user’s individual use and educational purposes only.

5.2.9 Using the website users will not impersonate any person or entity, misrepresent or provide false information about who they are or their affiliation with any person or entity.

 

5.3 Online meetings, including coaching and courses

5.3.1 Any online meetings will be conducted with the use of an appropriate meeting platform such as Google Meet, Teams, and/or an integrated video operated from the business’ web page.

5.3.2   Where applicable, the date and time for meetings will be sent to the customer. A time will be set that is convenient for the customer and trainers.

5.3.2 Online training courses will only be available at the prescribed time.

5.3.3   Customers must not film or record the event unless permission is given by SES which must be agreed with SES before the event.

5.3.4   Customers may not share any downloaded materials, including training materials unless permission is granted by SES.

 

5.4 User Accounts

5.4.1 If you create an account, you are responsible for maintaining the confidentiality of your login details and for all activities under your account.

5.4.2 You must not share login credentials, course access, or downloadable materials with others unless explicitly permitted.

5.4.3 We reserve the right to suspend or terminate accounts that breach these terms.

 

5.5 Booking and payment

5.5.1 All bookings made through SES website are subject to availability and confirmation.

5.5.2 Payment must be made in full at the time of booking unless otherwise stated.

5.5.3 Prices listed are inclusive of applicable taxes unless specified.

5.5.4 We are not liable for any indirect, incidental, or consequential damages arising from the use of our website or services.

5.5.5 Our total liability for any claim shall not exceed the amount paid by you for the service in question.

5.6 Cancellation and refunds

5.6.1 Cancellations must be submitted in writing by email or through your account dashboard

5.6.2 If cancelled more than 14 days before the course start date, a full refund will be issued minus up to 20 % of the invoice total as an administration fee.

5.6.3 If cancelled within 14 days of the course start date, a 50% refund will be issued.

5.6.4  Without prior cancellation SES reserves the right to retain full payment, this will result in no refund if the customer does not attend the booked course/event.

5.6.5 If the course includes downloadable or streamed content,refunds may not be available once access has been granted.

5.6.6 Requests for refunds due to medical or personal emergencies will be considered on a case-by-case basis. Supporting documents may be required. However, the expectation is that the customer will be re-booked on to an alternative course, of the same monetary value, without incurring additional fees.

5.6.7   Refunds, if applicable, will be processed using the original method of payment. Refunds will be processed within 21 days.

5.6.8    We reserve the right to cancel or reschedule a course due to unforeseen circumstances. In such cases, you will be offered a full refund or the option to transfer your booking to a future course.

Section CSafety

6.1 Any third party that is sent to your school on behalf of SES will be consultants/associates/trainers and will occur, if first agreed with our customer.

6.2   The Directors are UK citizens therefore, not requiring overseas checks. Consultants/associates, where applicable, will be checked for their right to work in the UK. DBS checks have been carried out and they will provide this information, as per requirement, such as when the consultant visits the school. They will be wearing a SES ID badge; it will include their photo.

6.3   Schools may use the DBS numbers to confirm and do their own checks.

6.4   Associates will undergo the appropriate safeguarding checks.

6.5   If the school has any concerns regarding anyone falsely presenting themselves as working for SES, the school should follow their own safeguarding protocols and notify SES of any such concern.

7 Personal Data

7.1   SES will use the customer’s personal data to process the booking.

7.2   SES from time-to-time will use customer’s personal data to review the service provided to them. It will not be used to give to marketing businesses.

7.3   If a testimonial is used and the name (school and person) is identified on any of SES’ literature and marketing platforms this will only be done after being given permission by the person or the school.

7.4   The person or school has a right to withdraw their consent and to request further information about the use of this information.

TERMS AND CONDITIONS FOR PUBLICATIONS

The name, logo, trademark, designs, slogans and any publications of Synergy Education Services Ltd are the intellectual  property of SES and may not be used, distributed, reproduced, amended without permission of a director of Synergy Education Services.
